This Privacy Policy has been developed in accordance with the Constitution of Ukraine, the GDPR (General Data Protection Regulation), the CCPA (California Consumer Privacy Act), the Civil Code of Ukraine, the Commercial Code of Ukraine, and the Law of Ukraine “On Personal Data Protection,” in accordance with Articles 420 and 505 of the Civil Code of Ukraine and Article 162 of the Commercial Code of Ukraine.

Terms

Privacy Policy – a digital agreement with an unlimited number of users of the website. By agreeing to the provisions of the Website Privacy Policy, the user provides unconditional consent for the collection, processing, storage, and transfer of personal data. The privacy provisions serve as the guiding document of the Website in handling personal data.

Website big-u.org (hereinafter – Website) – an informational Internet resource containing textual, graphic, and visual information, administered as a unified system through software tools.

User – any individual accessing the Website on their own behalf or on behalf of a legal entity.

Personal Data – any information about an individual visiting the website or using its services, which is identified or can be specifically identified directly or indirectly, including identifiers such as name, date of birth, location data, online identifiers, and other data that define the physical, physiological, genetic, mental, economic, cultural, or social identity of a person (e.g., age, gender).

Data Subject – an individual whose personal data is being processed.

Processing of Personal Data – any action or set of actions with personal data, including collection, registration, accumulation, storage, adaptation, modification, updating, use, dissemination, anonymization, or destruction, including via automated information systems.

Data Controller – a natural or legal person who determines the purpose of personal data processing, defines the scope of such data, and sets procedures for its processing unless otherwise provided by law.

Data Processor – a natural or legal person authorized by the data controller or by law to process personal data on behalf of the controller.

Personal Data Database – a named set of organized personal data of Users in electronic form.

Non-confidential Information – publicly available information from state or local records, such as professional licenses or public registry data; information lawfully made public by the User or disseminated by media; certain information disclosed by the User without access restrictions.

Third Party – any person other than the data subject, data controller, data processor, or the Ombudsman of the Verkhovna Rada of Ukraine, to whom personal data is transferred by the controller or processor.

Preamble

The BIG.U website, located at https://big-u.org/, is a non-commercial platform aimed at informing a broad audience about the Owner’s activities and facilitating communication with Users.

Website Owner (hereinafter – Owner) – Public Association “Business Incubator Group. Ukraine,” a non-profit, non-governmental organization registered and operating under Ukrainian law. The Owner acts as both the controller and processor of incoming and outgoing information on the Website, including personal data of Users – the data subjects.

Personal data is processed legally for fulfilling statutory objectives of the association and concerns only members or former members of the association, as well as individuals (natural and legal persons) who regularly, or within the framework of specific projects, maintain contact with the association and its members. Personal data is not disclosed outside the association without the consent of data subjects.

The association does not collect sensitive personal data, such as racial or ethnic origin, political beliefs, religious or philosophical views, union membership, genetic data, biometric data for unique identification, health information, sexual life, or sexual orientation.

Processing of Personal Data

Personal data is processed by the Public Association “Business Incubator Group. Ukraine” to fulfill statutory objectives and pertains exclusively to members, former members, and cooperating individuals. Data is not disclosed outside the association without consent.

Data is processed at data centers hosting the website infrastructure and may be stored in the personal data database or in separate database tables.

When completing electronic feedback forms, the following voluntarily provided information may be processed:

  • Name

  • Email address

  • Phone number

  • Additional information (e.g., gender, date of birth, marital status, hobbies, education, workplace)

By submitting the form, the User consents to the processing of personal data as provided.

When subscribing to newsletters, the following information is processed: name and email address provided by the User.

Information provided for publication on the website, including username, profile image, and content, is also processed.

Any personal information sent via email or through the website, including content and metadata, is considered personal data.

Before providing personal information about a third party, the User must obtain that third party’s consent for disclosure and processing.

Storage and Protection of Personal Data

The Owner employs generally accepted technological and operational standards to protect information and personal data from loss, misuse, alteration, or destruction.

Absolute protection cannot be guaranteed against external threats.

Access to personal data is granted only to authorized personnel who have agreed to maintain confidentiality per Ukrainian law and the Owner’s requirements.

Personal data may only be shared without consent in cases defined by Ukrainian law, international agreements, or in the interests of national security, economic well-being, or human rights.

Rights of Users

Users have the right to:

  • Know what personal information the Owner collects and how it is used or shared.

  • Correct or delete personal information (except non-confidential data) by emailing the Owner. Some information may be retained for legal obligations, claims, or internal purposes.

  • Refuse to provide certain personal information. If such refusal affects the quality or results of cooperation, the Owner may decline further interaction.

  • Be free from discrimination. Users exercising their rights cannot be denied access to the website.
